How should I choose a law firm or attorney?
Knowledge counts. Choose an attorney who knows the law and understands your business — someone who will work with you, not talk down to you. A good working relationship is essential; a good attorney will make you want to work with her.
Praxis works with clients to develop free arrangements suited to client's needs.
Options include:
Hourly – Where it is difficult to predict time requirements and a client wishes to engage services on an as-needed basis, hourly billing provides flexibility and control.
Retainer – For clients with predictable time requirements, a retainer agreement providing guaranteed, scheduled availability is the lowest-cost option.
Project – For single or periodic assignments, a project rate is available. A per-project fee works best in situations where the scope of work is clearly defined and the outcome does not depend on factors outside the control of the attorney or the client, e.g. third parties or government agencies.
What is the difference between Praxis Legal Solutions and traditional law firm?
Praxis is a generalist firm with broad experience in diverse areas of law and a high degree of familiarity with the issues that arise for business owners on a day-to-day basis. When you require the services of a specialist — for example, in tax law — Praxis can help you keep costs low by flattening the learning curve. How responsive is Praxis Legal Solutions? Praxis is available by phone, e-mail, or face-to-face. Generally, Praxis can respond on a same-day basis and always within 24 hours.
What types of fee arrangements and payments suited to clients' needs.
Praxis bills for its time; there are no added charges. Out-of-pocket expenses for items such as filing fees or overnight delivery charges are not subject to mark-up and are clearly itemized. Clients are billed monthly, and may pay by check or credit card.
What types of matters does Praxis not handle?
Our practice does not include litigation, family law, criminal law, estates and trusts, tax law, patent law or residential real estate closings. For clients who require assistance in these areas, Praxis maintains a network of qualified legal professionals who can provide specialized expertise.
Labor and Employment
May employers discriminate?
Employers discriminate all the time. Some employees are paid more than others; some have better jobs or offices, or are promoted more quickly than their co-workers. As long as employment decisions are based on merit, and not on factors such as age, race, gender, marital or veteran status or religious beliefs or disability, employers have wide latitude in who they hire, fire or promote, and how they compensate employees.
Which employers are subject to the Americans with Disabilities Act?
Employers with 15 or more employees are subject to the requirements of the Americans with Disabilities Act.
Litigation Management
Does Praxis Legal Solutions handle litigation?
No. Litigation is costly and slow, and with its enormous demands on the time and attention of everyone involved, it has the potential to seriously disrupt the operations of a business. At Praxis, the focus is on resolving problems without resorting to litigation. Where litigation is the only available option, Praxis can help you choose the right litigator and manage the litigation to hold down costs.
Mergers and Acquisitions
Is it better to merge with, or to acquire another company?
Each type of transaction has advantages and disadvantages. Companies may merge because a merger can be accomplished without cash; or because a merger can be tax-free to both parties. In an acquisition, the acquiring company can exclude certain assets and liabilities, making the target more attractive to the acquiring party.
What is the difference between a merger and an acquisition?
In a merger, two companies come together to form a new company. In an acquisition, one company acquires another, and the acquired company ceases to exist.
